LA RELACIÓN CANÓNICA E INTERNACIONAL DE LA SOBERANA ORDEN DE MALTA CON LA SANTA SEDE
RESUMEN
La Soberana orden de Malta es una orden religiosa, y como tal, sometida al Derecho canónico; pero también es un sujeto del Derecho internacional. Esa dualidad de caracteres comporta que su relación con la Santa Sede esté regulada tanto por el Derecho canónico como por el Derecho internacional público. Tras una referencia introductoria relativa a la historia de la Orden de Malta y a la evolución de su actividad hospitalaria, militar y humanitaria, el estudio se adentra en las fuentes del llamado derecho melitense, que es el Derecho propio de la Orden de Malta, donde se descubren las claves de su doble relación jurídica con la Santa Sede. A continuación, se estudia la subjetividad internacional de la Orden de Malta, incidiendo especialmente en su carácter soberano así como en los mecanismos de actuación de la Orden en el plano internacional, como las relaciones diplomáticas o la firma de tratados internacionales. Para finalizar, se aborda el estudio de su carácter de orden religiosa, incidiendo en la importante sentencia del Tribunal especial cardenalicio establecido en 1951 por el papa Pío XII.
ABSTRACT
The Sovereign Order of Malta is a religious order, and as such, it’s subject to canon law, but also it’s a subject of international law. This duality of character involves his relationship with the Holy See, that it’s governed both by canon law and by international law. After an introductory reference on the history of the Order of Malta and the evolution of its hospital, military and humanitarian activity in the hospital activity, the study delves into the sources of the Order of Malta’s Law, where are the keys to its dual legal relationship with the Holy See. Next, we analyze the international subjectivity of the Order of Malta, with special emphasis on its sovereign character as well as the mechanisms of action of the Order in the international level, such as the diplomatic relations or the signing of international treaties. Finally, we study its nature of religious order, focusing on the important decision of the Special Court established in 1951 by Pope Pius XII.
