La restitutio natalium romana, precedente de las dispensas canónicas obtenidas por Alonso Antonio de San Martín entre 1658 y 1675
Resumen
Alonso de San Martín, hijo ilegítimo de Felipe IV, procreado de madre soltera, fue promovido a órdenes sagradas entre 1658 y 1675, desde la tonsura al episcopado, e investido de diferentes beneficios eclesiásticos, con mayor relevancia como abad de Alcalá la Real (Jaén), y más tarde, en 1675, al obispado de Oviedo, aunque finalmente su hermanastro Carlos II lo promovió a la mitra de Cuenca, en 1681. En su calidad de hijo ilegítimo precisó de la dispensa canónica para recibir la ordenación. Inicialmente le fue otorgada por su obispo diocesano, pero más tarde tuvo que recurrir a la autoridad pontificia, que se la concedió reiteradamente hasta la consagración episcopal, mostrándose la relación de este privilegio papal con el instituto del Derecho romano conocido como la restitutio natalium, en cuanto precedente histórico-jurídico. Abstract
Alonso of St Martin, illegitimate child of Philip IV, procreated of single mother, was promoted to sacred orders between 1658 and 1675, from the tonsure to the episcopate, and ungarment of different ecclesiastic benefits, with major relevancy as abbot of Alcala la Real (Jaen), and later, in 1675, to the bishopric of Oviedo, though finally his step-brother Carlos II promoted it to the miter of Cuenca, in 1681. In his illegitimate child’s quality it was necessary the canonical dispensation to receive the arrangement. Initially he was given by his diocesan bishop, but later had to resort to papal authority which granted it repeatedly until the episcopal consecration, showing the relationship of this papal privilege with the Institute of Roman law known as natalium restitutio in as historical and legal precedent.
