La convalida del matrimonio canonico

REDC 65 (2008) 563-590 LA CONVALIDA DEL MATRIMONIO CANONICO RESUMEN El CIC da una serie de soluciones para resolver los vicios de nulidad del matrimonio canónico, entre los que está acudir al procedimiento de convalidación. El artículo se ocupa de los dos modos en los que puede darse la convalidación del matrimonio: la convalidación simple y la «sanatio in radice». En el epígrafe primero se estudia la regulación de la convalidación simple en el CIC de 1917. Éste preveía tres hipótesis según que el matrimonio fuese nulo por la existencia de un impedimento dirimente, por un defecto o vicio, o por defecto de forma. El CIC actual mantiene sustancialmente la misma normativa. En el epígrafe II se examina la institución de la sanación en raíz, modo extraordinario de convalidación del matrimonio, en ambas legislaciones. ABSTRACT The CIC gives a several solutions to solve the vices of nullity of the canonical marriage; one of them is to come to the procedure of confirmation. The article deals with both manners in which one can give the confirmation of the marriage: the simple confirmation and the «sanatio in radice». The first epigraph studies the regulation of the simple confirmation in the CIC of 1917, when was foreseeing three hypotheses according to which the marriage was void for the existence of an annulling impediment, for a fault or vice, or for fault of form. The current CIC supports substantially the same regulation. The second epigraph examines the institution of the “sanatio in radice”, extraordinary way to confirm the marriage, in both legislations.
