NORMATIVA MATRIMONIAL CIVIL ESPAÑOLA. ÚLTIMAS REFORMAS LEGISLATIVAS CONSIDERACIÓN LEGAL DE NUEVAS FORMAS MATRIMONIALES EN EL DERECHO ESPAÑOL
RESUMEN
El principio constitucional de cooperación entre el Estado y las confesiones religiosas de mayor relevancia social o de «notorio arraigo» en nuestro país, se formalizó en los acuerdos de cooperación firmados por el Estado con la Santa Sede y los posteriores con musulmanes, judíos y evangélicos. En todos estos acuerdos se reconocen efectos civiles a sus ritos matrimoniales. Posteriormente se ha reconocido ese «notorio arraigo» a otras confesiones religiosas como los testigos de Jehová, mormones, budistas y cristianos ortodoxos. Tal reconocimiento legal es el paso previo a la posibilidad de negociación y firma de un acuerdo de cooperación con el Estado en el que, con toda seguridad, también se reconocerían efectos civiles a sus ritos matrimoniales. Del mismo modo, la Sentencia del Tribunal Europeo de Derechos Humanos, de 8 de diciembre de 2009, en el caso «Muñoz Díaz vs. España», aludía también al hecho religioso en su reconocimiento de efectos civiles al matrimonio gitano contraído por la demandante. Este artículo analiza la aptitud del actual sistema matrimonial español para encuadrar en él a estos nuevos ritos matrimoniales, y los posibles problemas respecto de la poligamia y el reconocimiento civil del matrimonio tradicional gitano.
ABSTRACT
The constitutional principle of cooperation between the State and religious denominations of greater social or «notorio arraigo» in our country, was formalized in the cooperation agreements signed by the State with the Holy See and later muslims, jews and evangelicals. In all these agreements are recognized civil effects to their marriage rites. It was later recognized that «notorio arraigo» to other faiths such as Jehovah’s witnesses, mormons, buddhists and orthodox christians. Such recognition is a prelude to the possibility of negotiation and signing of a cooperation agreement with the State in which, surely, also be recognized civil effects to their marriage rites.
