LA REMISIÓN DE LA EXCOMUNIÓN LATAE SENTENTIAE DECLARADA A CUATRO OBISPOS DE LA FRATERNIDAD SACERDOTAL DE SAN PÍO X: ANÁLISIS CANÓNICO Y REPERCUSIONES
RESUMEN
El 1 de julio de 1988, la Congregación para los obispos declaraba la pena de excomunión latae sententiae a seis Obispos por los delitos de la consagración episcopal sin mandato pontificio (c.1382) y de cisma (c.1364,§1). Veinte años después, el 21 de enero de 2009, la misma Congregación remitía esta pena a los cuatro obispos que siguen vivos, lo cual ha suscitado una amplia polémica en sectores de La comunidad eclesial. E1 autor del artículo analiza, en primer lugar, la configuración canónica del delito de la consagración episcopal sin mandado pontificio, tanto en el CIC de 1917 como en el actual, incluyendo las distintas intervenciones de la Sede Apostólica en este tema, para posteriormente describir el proceso por el que se llegó a declarar la excomunión de Mons. Lefebvre y de otros Obispos; la constitución de la Comisión Pontificia «Ecclesia Dei» que se encargaba de todo lo relacionado con la Fraternidad Sacerdotal San Pío X; los pasos dados por la Sede apostólica para facilitar la reconciliación; y, finalmente, el Decreto de remisión del 2009, por el que se levanta la excomunión declarada, analizándolo canónicamente así como la repercusión que ha creado en la comunidad eclesial.
SUMMARY
On the 1st July 1988, the Congregation for Bishops declared the penalty of excommunication latae sententiae on six bishops for the crimes of Episcopal consecration without pontifical mandate (c.1382) and schism (c.1364§1). Twenty years later, on the 21st January 2009, the same Congregation remitted this penalty on the four bishops who are still alive; this caused great discussion in parts of the ecclesial community. In the first place, the author analyses the canonical configuration of the crime of Episcopal consecration without papal mandate in both the 1917 and the present Code, including the different interventions of the Holy See on this theme, in order to then describe the process which led to the excommunication of Mgr. Lefebvre and the other bishops; the constitution of the Pontifical Commission «Ecclesia Dei», which was in charge of everything related to the Priestly Fraternity of Saint Pius X; the steps taken by the Holy See to facilitate reconciliation; and, finally the Decree of Remission which lifted the declared excommunication; a canonical analysis is offered, along with a look at the repercussions which it has created within the ecclesial community.
