REDC 67 (2010) 731-740 ALCUNI RILIEVI SUL VALORE PROBATORIO DELL’INFEDELTÀ NELLE CAUSE DI NULLITÀ DEL MATRIMONIO PER ESCLUSIONE DEL BONUM FIDEI RESUMEN El artículo intenta indagar en la posible relevancia de la infidelidad como medio de prueba en las causas de nulidad del matrimonio ante los Tribunales de la Iglesia. Partiendo de una valoración del capítulo de exclusión de la fidelidad, en general, en la doctrina canónica clásica —en primer lugar de la canonística medieval—, el estudio llega a examinar el valor de la infidelidad como medio de prueba en la jurisprudencia, basándose en algunas sentencias fundamentales de la Rota Romana, así como su valor de elemento indiciario, pasando finalmente a revisar la presunción y los principales criterios procesales utilizados por los jueces eclesiásticos para la valoración de la invalidez del matrimonio por exclusión del bonum fidei. ABSTRACT The article tries to investigate the possible relevance of infidelity as evidence in cases of nullity of marriage before the ecclesiastical courts. Based on a review of the chapter of the fidelity exclusion, in general, in the classical canonical doctrine —first in the medieval canonist—, the study comes to examine the value of infidelity as evidence in jurisprudency, based on some key judgments of the Roman Rota, as well as its value as indiciario element, finally going to review the presumption and the main procedural criteria used by the ecclesiastical judges for the assessment of invalidity of marriage by excluding the bonum fidei.
