REDC 67 (2010) 139-150 L’INTENTIO SIMULATORIA NELLA TRADIZIONE CANONICOMATRIMONIALE: BREVI CENNI SULLA FATTISPECIE REALE E CONDIZIONALE NELLA FORMAZIONE DEL VOLITUM ESCLUDENTE RESUMEN El artículo tiene como objetivo ofrecer una panorámica de las formas de manifestación de la «intentio simulatoria» en la tradición canónico-matrimonial. Inicialmente el artículo se centra en la doctrina canónica medieval, con el examen de las decretales de Inocencio III Tua Nos, de Gregorio IX Si condiciones, Inocencio IV Habemus y del canon Aliquando contenido en el Decreto de Graciano. Posteriormente se analiza la doctrina del cardenal Gasparri que individuó por primera vez el concepto de «acto positivo de la voluntad», adaptando su Tractatus canonicus de matrimonio al Código de Derecho Canónico de 1917. Al final del artículo se cita la sentencia coram Many de 1911 y se describen los desarrollos interpretativos sucesivos, con una referencia especial a la estructura y características del acto positivo de la voluntad. SUMMARY The article aims to provide an overview of the manifestation forms of the «intentio simulatoria» in the canonical tradition of marriage. Initially, the article focuses on the medieval canonical doctrine, with an examination of the decrees of Innocent III Tua Nos, Gregory IX Si condiciones, Innocent IV Habemus and the canon Aliquando contained in Gratian Decree. Finally, we examine the doctrine of Cardinal Gasparri that for the first time individualized the term «positive act of will», adapting his Tractatus Canonicus de matrimonio to the Code of Canon Law of 1917. The end of the article quotes the sentence coram Many in 1911 and describes the subsequent interpretative developments, with particular reference to the structure and characteristics of the «positive act of will».
